Acceptance of Terms and Conditions

When you decide to become a Member of Sultana, you agree to be unequivocally bound by these Membership Terms and Conditions and our Privacy Policy Terms incorporated by reference into this Agreement (collectively, this “Agreement”).

We reserve the right to amend the terms of this Agreement. This might be required because of changes in the applicable laws, changes in our business practices or the incorporation of new services.

We will notify you with reasonable means such as emails, if any change materially affects your rights or obligations under this Agreement.

By electing to continue using our Services following the implementation of these changes, you will be considered bound by the updated version of the Terms of this Agreement.

You agree that the terms of this Agreement shall supersede any prior agreements and shall govern the entire relationship between Sultana and you, including but not limited to events, agreements, and any conduct preceding your acceptance of this Agreement.

Eligibility

In order to become a Client or Member of Sultana and use our Matchmaking Services, you must be at least 18 years old.

Summary of Terms

Confidentiality, honesty and trust are of paramount importance for us. Sultana distinguishes itself from other matchmaking websites for the high quality services we offer and the success stories of our Clients.

When you use our Services, you represent and confirm that you:

  • Are single (or are separated from your spouse);
  • All the Details you have provided are truthful, accurate and complete;
  • Are looking for a sincere relationship;
  • Do not have any criminal convictions;
  • Neither are an employee of any other matchmaking company, nor are you affiliated personally or professionally with other matchmaking companies or agencies.

You are prohibited from:

  • Deliberately or recklessly harming the reputation of Sultana or the reputation of any Client and Member of Sultana, and from making defamatory or disparaging statements publicly available;
  • Making defamatory or negative statements (either verbally or in writing) about Sultana, the services we provide or any Client and Member of Sultana to any Third Party;
  • Disclosing Confidential Information to any Third Party (and you will take the utmost care to keep Confidential Information secure and protected and to ensure that you do not inadvertently disclose Confidential Information);
  • Causing a nuisance, inconvenience or anxiety to any Client, Member or employee of Sultana, or contact them after they have explicitly notified you that they do not wish any further communication.
  • Acting in an abusive, threatening, harassing, obscene, libelous, offensive, sexist, racist or discriminatory manner towards any Client, Member and employee of Sultana.
  • Obstructing anyone else from using and enjoying Sultana’s services
  • Impersonating another person;
  • Using our services for any commercial purpose such as to promote products or services to other Clients and Members;
  • Providing us with any photograph or other material the copyright in which belongs to a Third Party.

Sultana shall terminate the Agreement at any time immediately without notice to you, shall erase your data and prohibit you from using again our Services, if:

  • You have provided us with materially misleading and false information about yourself,
  • You have breached any of the terms of this Agreement.
  • Sultana reserves all the legal rights and remedies; it is entitled to without any prejudice.

The Services

  • Sultana is committed to search for suitable Matches amongst its Clients and Members and may make a reasonable presentation of your Bio to potential Matches.
  • You will respond promptly to communications from Sultana (no more than 7 days).
  • You will inform Sultana of any changes to your Relationship, Financial and Professional Status as soon as possible.
  • You have the right to terminate your Membership at any time for any reason by contacting Sultana.
  • Every month you will receive a newsletter via email, which contains a link. By clicking on this link, you will have the option to terminate your relationship with Sultana and have your information erased from our databases.

Limitation of Liability

You agree that all information you submit to Sultana is truthful and accurate.

Sultana relies on the integrity and accuracy of the information and details provided by our Clients and Members. We respect your privacy and we do not conduct background checks except for performing routine verification checks using public information available online.

You acknowledge that Sultana cannot guarantee the outcome of the date you may have or the success of a resulting relationship; we cannot control the response that other Clients or Members may have after a potential introduction of your Bio to them.

You agree to give feedback to Sultana about your dating experiences and interaction with your Matches. This feedback will help us to improve our services and increase your chances to find your perfect Match.

We are not responsible for the interactions you might have with other Clients and Members or for the behavior or actions of any other Client and Member.

Sultana does not conduct Criminal or Background Checks and makes no warranty or representation about the marital status, mental state and criminal record of any member.

You agree to use caution in all interactions with other Clients and Members, when you decide to communicate or meet them in person. You must take reasonable precautions including but not limited to arranging any meeting in a public place and not providing your financial information, for example, your credit card or bank account details, or wire or otherwise send money, to other Clients and Members.

Sultana has no responsibility to arbitrate in disputes between Members.

You agree, to the extent permitted under applicable law, to indemnify, defend and hold harmless Sultana, our affiliates, and their respective officers, directors, agents, and employees from and against any and all complaints, demands, claims, damages, losses, costs, liabilities and expenses, including attorney’s fees, due to, arising out of, or relating in any way to your access to or use of our Services, or your breach of this Agreement.

Purchases

Sultana may offer products and services for purchase through iTunes, Google Play or other external services authorized by Sultana (each, an “External Service,” and any purchases made thereon, an “External Service Purchase”). Sultana may also offer products and services for purchase via credit card or other payment processors on the Website or inside the App (“Internal Purchases”). If you purchase a subscription, it will automatically renew until you cancel, in accordance with the terms disclosed to you at the time of purchase, as further described below. If you cancel your subscription, you will continue to have access to your subscription benefits until the end of your subscription period, at which point it will expire.

External service purchases and subscriptions

External Service Purchases, including subscriptions, may be processed through the External Service, in which case those purchases must be managed through your External Service Account. Subscriptions automatically renew until you cancel.

When making a purchase on the Service, you may have the option to pay through an External Service, such as with your Apple ID or Google account (“your External Service Account”), and your External Service Account will be charged for the purchase in accordance with the terms disclosed to you at the time of purchase and the general terms applicable to your External Service Account. Some External Services may charge you sales tax, depending on where you live, which may change from time to time.

If your External Service Purchase includes an automatically renewing subscription, your External Service Account will continue to be periodically charged for the subscription until you cancel. After your initial subscription commitment period, and again after any subsequent subscription period, the subscription will automatically continue for the price and time period you agreed to when subscribing.

To cancel a subscription: If you do not want your subscription to renew automatically, or if you want to change or terminate your subscription, you must log in to your External Service Account and follow instructions to manage or cancel your subscription, even if you have otherwise deleted your account with us or if you have deleted the App from your device.

If you initiate a chargeback or otherwise reverse a payment made with your External Service Account, Sultana may terminate your account immediately in its sole discretion, on the basis that you have determined that you do not want a Sultana subscription. In the event that your chargeback or other payment reversal is overturned, please contact customer care. Sultana will retain all funds charged to your External Service Account until you cancel your subscription through your External Service Account.

Internal purchases and subscriptions

Internal Purchases, including subscriptions, are processed using the Payment Method you provide on the Website or App. Subscriptions automatically renew until you cancel.

If you make an Internal Purchase, you agree to pay the prices displayed to you for the Services you’ve selected as well as any sales or similar taxes that may be imposed on your payments (and as may change from time to time), and you authorize Sultana to charge the payment method you provide (your “Payment Method”). Sultana may correct any billing errors or mistakes even if we have already requested or received payment. If you initiate a chargeback or otherwise reverse a payment made with your Payment Method, Sultana may terminate your account immediately in its sole discretion, on the basis that you have determined that you do not want a Sultana subscription. In the event that your chargeback or other payment reversal is overturned, please contact customer care.

If your Internal Purchase includes an automatically renewing subscription, your Payment Method will continue to be periodically charged for the subscription until you cancel. After your initial subscription commitment period, and again after any subsequent subscription period, your subscription will automatically continue for the price and time period you agreed to when subscribing, until you cancel.

To cancel a subscription, log in to the Website and go to the Settings tool. If you cancel a subscription, you may continue to use the cancelled service until the end of your then-current subscription term. The subscription will not be renewed when your then-current term expires.

You may edit your Payment Method information by using the Settings tool. If a payment is not successfully processed, due to expiration, insufficient funds, or otherwise, you remain responsible for any uncollected amounts and authorize us to continue billing the Payment Method, as it may be updated. This may result in a change to your payment billing dates.

In addition, you authorize us to obtain updated or replacement expiration dates and card numbers for your credit or debit card as provided by your credit or debit card issuer. The terms of your payment will be based on your Payment Method and may be determined by agreements between you and the financial institution, credit card issuer, or other provider of your chosen Payment Method. Certain users may be entitled to request a refund.

Refunds

Generally, all purchases are final and nonrefundable, and there are no refunds or credits for partially used periods, except if the laws applicable in your jurisdiction provide for refunds.

For subscribers residing in the EU or European Economic Area, in accordance with local law, you are entitled to a full refund without stating the reason during the 14 days after the subscription begins. Please note that this 14-day period commences when the subscription starts.

Purchases of Virtual Items are FINAL AND NON-REFUNDABLE.

If any of the above apply to you and you subscribed using your Apple ID, your refund requests are handled by Apple, not Sultana. To request a refund please contact your External Service directly; for example using your Apple device, go to Settings > iTunes & App Stores > [click on your Apple ID] > View Apple ID > Purchase History. Find the transaction and select “Report a Problem.” You can also request a refund at https://getsupport.apple.com.

For any other purchase, please contact Sultana Customer Service with your order number (see your confirmation email) by mailing or delivering a signed and dated notice which states that you, the buyer, are canceling this agreement, or words of similar effect. Please also include the email address or telephone number associated with your account. This notice shall be sent to Sultana.

Pricing Sultana works a worldwide business and offers types of assistance to an assorted network of individuals. Our evaluating structure may fluctuate by locale, length of membership, group size, later in-application advancements and different components. We oftentimes test new highlights and cost focuses to furnish individuals with expanded usefulness and installment alternatives should they decide to utilize them.

Confidentiality and Data Protection

You agree that Sultana will store in its servers and process your personal information (including any sensitive personal information) in order to provide you with high quality Services, communicate with you and for marketing, statutory and accounting purposes.

We will keep your Private information secured and protected by employing high standard security measures.  For more information, please refer to our Privacy Policy.

All Clients and Members undertake to keep confidential the private information they received regarding other Clients and Members, their interactions with other Clients and Members, the Matchmaking and Dating Services they receive from Sultana. All Clients and Members agree that they will not use the information of another Client and Member, and Sultana Services for any unlawful, nefarious or criminal purpose.

Sultana will exercise its rights to terminate the Membership of any Client and Member, who breaches the obligations of confidentiality and reserves the right to take any legal action to enforce these obligations. All Clients and Members possess equal rights to initiate any legal action against other Clients and Members, who breach the terms of this Agreement.

General

Sultana reserves all copyright, trademark and any other intellectual property rights in any materials or content that is part of the Sultana Website and the Services provided to you.  You are strictly prohibited from copying or distributing or making public any such materials or content except for your own personal non-commercial use. Sultana reserves the right to take such legal action as may be appropriate to stop or prevent infringement of such rights.

No failure or delay on the part of any Party in exercising any right, power or privilege under these Terms shall constitute a waiver of, nor shall any single or partial exercise of any such right, power or privilege preclude, any other or further exercise of any other right, power or privilege.
